Seller shall not be liable for any special, indirect, incidental, or consequential damages or losses; any damages, costs or expenses in excess of the payment actually received by Seller from Buyer; or any claims, damages or losses to the extent arising out the negligence or misconduct of the Buyer, or the improper installation, misuse, or abuse of the product sold by Seller. 9.
