It has replacement batteries and it lights up when you put it down on a table (see video). You drag the bottom of the top against a surface to "wind" it so it spins, drop the top down and the lights change color and the ball inside rolls around it. There is NO whistling sound and never was on this toy! It is in VG-EX shape, but has a few scuffs from play. Box is in EX shape.
